Mishawaka Police Cpl. James Szuba, 42, and his K-9 partner, Ricky, were killed in a traffic accident late Saturday night. Szuba joined the Mishawaka Police Department on Feb. 26, 2002. His K-9 partner Ricky, was 8 years old.

The accident occurred about 9:20 p.m. on Byrkit Street just south of McKinley Avenue. The officer involved in the accident was providing assistance on a call and was traveling southbound on Fir when the squad car was sideswiped by another vehicle. The driver of that vehicle has been identified as Shawn Devine, 31, of Mishawaka, according to a news release issued early Sunday morning from the St. Joseph County Prosecutor's Office.

Police believe alcohol is a factor in the crash, according to the news release. Devine was taken to a local hospital for treatment of his injuries. Toxicology tests have been performed. The Fatal Alcohol Crash Team is investigating the accident.

Cpl. Szuba's badly damaged squad car was on the side of the BP service station, which on the southeast corner of McKinley and Byrkit. Fir Road turns into Byrkit Street on the south side of McKinley. In addition, to the FACT unit, officers from the Indiana State Police and the St. Joseph County Police provided assistance.

Szuba is survived by a wife and two children.
